1. INTRODUCTION AND ACCEPTANCE OF TERMS
Welcome to Oaks Health Associates, PC ("Oaks Health," "we," "us," or "our").
These Terms of Service ("Terms") govern your access to and use of our website, online scheduling systems, patient portals, telemedicine platforms, and healthcare services.
Oaks Health provides healthcare services through appropriately licensed and credentialed healthcare professionals, including nurse practitioners, physician assistants, and collaborating or supervising physicians, as applicable.
By accessing our website or using our online services, you agree to comply with these Terms.
Patients receiving medical services may also be required to review and sign additional agreements, including informed consent documents, financial policies, telehealth consent forms, and procedure-specific acknowledgments.
If you do not agree with these Terms, please discontinue use of the website.
Nothing in these Terms is intended to waive any rights or protections provided to patients under applicable federal or state law.
2. SERVICES PROVIDED
Oaks Health offers a range of healthcare and wellness services, which may include:
Primary care and preventive healthcare
Acute and chronic disease management
Medical weight management
Telemedicine and virtual healthcare consultations
Intravenous hydration and nutrient infusion therapy
Medical aesthetics and cosmetic procedures
Wellness consultations and services
Laboratory testing and diagnostic services
Prescription medication management
Other healthcare services within the scope of our clinicians' professional licenses
Services may be offered in person, through telemedicine, or through other legally permitted healthcare delivery methods.
Availability varies according to the patient's location, clinician availability, medical eligibility, and applicable laws.
Oaks Health reserves the right to modify, discontinue, or expand its service offerings at any time.
3. MULTISTATE TELEMEDICINE SERVICES
3.1 Telemedicine Availability
Oaks Health provides telemedicine services to eligible patients located in multiple U.S. states.
Telemedicine services are available only when the treating healthcare professional is appropriately licensed or otherwise legally authorized to provide the requested services in the state where the patient is physically located at the time of the encounter.
Our current service areas may include:
North Carolina, Virginia, Vermont, Florida, Texas, Nevada, Nebraska, Alaska, Hawaii, California, Colorado, Iowa, New Mexico, and Utah.
Important: Inclusion of a state in this list does not guarantee that every Oaks Health clinician is authorized to provide every service in that state.
Service availability depends on individual clinician licensure, applicable practice requirements, prescribing restrictions, and other relevant state and federal regulations.
Oaks Health may add or remove states from its telemedicine service area as necessary.
3.2 Patient Location Verification
Before receiving telemedicine services, patients must provide accurate information regarding their physical location.
Patients may be required to verify:
Full legal name
Date of birth
Current physical address
State of residence
Physical location at the time of the appointment
Contact information
Emergency contact information
Other information necessary for safe and lawful treatment
Patients must notify Oaks Health if they are traveling or located outside their usual state of residence.
A clinician may decline, cancel, or reschedule an appointment if the patient is located in a jurisdiction where the clinician is not authorized to practice.
Providing inaccurate information about physical location may result in the inability to receive telemedicine services.
3.3 Establishment of the Provider-Patient Relationship
A provider-patient relationship is established only when an appropriately authorized healthcare professional accepts the patient for care and performs an evaluation or otherwise establishes the relationship in accordance with applicable law.
Submitting an appointment request, completing an intake questionnaire, making a payment, or communicating through the website does not independently establish a provider-patient relationship.
Oaks Health reserves the right to decline treatment when services are not clinically appropriate or cannot legally be provided.
3.4 Telemedicine Limitations
Telemedicine may involve video consultations, telephone encounters, secure electronic communications, and asynchronous clinical evaluations when permitted by law.
Patients acknowledge that telemedicine has limitations, including:
Inability to perform a comprehensive hands-on physical examination
Potential technology interruptions
Limitations in evaluating certain medical conditions remotely
Possible need for additional laboratory testing or imaging
Possible need for referral to an in-person healthcare facility
Potential privacy and security risks associated with electronic communication
Oaks Health clinicians may determine that telemedicine is not appropriate for a particular medical concern.
In these circumstances, patients may be advised to obtain in-person evaluation.
3.5 Telemedicine Consent
Patients must provide any informed consent required by applicable law before receiving telemedicine services.
Consent may be obtained electronically, verbally, or in writing, as legally permitted.
A separate telemedicine consent document may be required.
Patients have the right to ask questions about telemedicine and to decline telemedicine services.
Declining telemedicine does not necessarily guarantee that Oaks Health can provide the requested service in person.
4. MEDICAL ELIGIBILITY AND CLINICAL DECISION-MAKING
All medical services are subject to clinical evaluation and professional judgment.
Scheduling an appointment or purchasing a consultation does not guarantee:
Acceptance into a treatment program
Prescription medication approval
A specific diagnosis
A particular treatment recommendation
Eligibility for an aesthetic procedure
Laboratory testing approval
A particular clinical outcome
Oaks Health clinicians retain independent professional judgment regarding patient care.
Treatment may be declined, modified, postponed, or discontinued when clinically indicated.
Patients agree to provide accurate and complete information about their medical history, medications, allergies, existing conditions, and relevant health concerns.
Failure to disclose important medical information may affect patient safety and treatment eligibility.
5. PRESCRIPTION MEDICATIONS
5.1 Prescribing Policies
Prescription medications are provided only when an authorized clinician determines that treatment is medically appropriate and legally permissible.
Prescriptions are not guaranteed.
Oaks Health may require:
A completed medical evaluation
Review of medical history
Laboratory testing
Follow-up appointments
Ongoing monitoring
Verification of identity and physical location
Oaks Health reserves the right to decline or discontinue prescribing when appropriate.
5.2 Compounded Medications
Certain treatment programs may involve compounded prescription medications when clinically appropriate and legally permissible.
Patients acknowledge that compounded medications are not FDA-approved and have not undergone the FDA's premarket review for safety, effectiveness, or quality.
Compounded medications may have different formulations, concentrations, ingredients, and preparation requirements.
The availability of compounded medications is subject to applicable federal and state laws, including restrictions on compounding copies of commercially available FDA-approved medications.
Oaks Health does not guarantee the availability of any particular compounded medication.
5.3 Pharmacy Fulfillment and Shipping
Prescription medications may be dispensed and shipped by independent licensed pharmacies.
Once a prescription is transmitted to a pharmacy, fulfillment and shipping timelines may depend on factors outside Oaks Health's direct control.
These factors may include:
Pharmacy processing times
Medication availability
Compounding requirements
Prescription verification
Shipping carrier delays
Weather-related disruptions
Federal or state regulatory restrictions
Holidays and pharmacy closures
Estimated shipping or delivery dates are not guaranteed.
Patients are encouraged to request refills sufficiently in advance to avoid interruptions in therapy.
Oaks Health is not responsible for delays caused solely by independent pharmacies or shipping carriers. However, this provision does not limit responsibility imposed by applicable law for the practice's own actions or omissions.
Patients experiencing a medication interruption should contact Oaks Health through the designated patient portal for individualized clinical guidance.
Patients should not independently increase, decrease, or restart medication doses without appropriate clinical guidance.
5.4 Medication Refunds
Prescription medications dispensed by a pharmacy generally cannot be returned or restocked after dispensing, subject to applicable law and pharmacy policy.
Refund eligibility depends on the circumstances, including whether a prescription has been processed, compounded, dispensed, or shipped.
Refund requests will be reviewed individually in accordance with applicable law and the relevant pharmacy's policies.
Nothing in this section limits legally required refunds or remedies.
6. MEDICAL WEIGHT MANAGEMENT SERVICES
Oaks Health offers medical weight management services for eligible patients.
Treatment plans may include nutritional counseling, lifestyle recommendations, laboratory monitoring, prescription medications, and ongoing clinical follow-up.
Patients understand that:
Weight loss results vary.
No specific amount of weight loss is guaranteed.
Medication approval depends on medical eligibility.
Treatment may require periodic follow-up and laboratory testing.
Medication dosage adjustments are determined by the treating clinician.
Certain medical conditions may make treatment inappropriate.
Weight management medications may cause adverse effects.
Patients must follow prescribed treatment instructions and notify their clinician of significant side effects or changes in health status.
Oaks Health may discontinue treatment when clinically indicated.
7. IV HYDRATION AND WELLNESS THERAPIES
Oaks Health may provide intravenous hydration, vitamins, minerals, and other wellness therapies.
All IV treatments are subject to medical screening and clinical eligibility.
Patients acknowledge that intravenous therapy carries potential risks, including:
Bruising or discomfort at the injection site
Infection
Allergic reactions
Vein irritation
Fluid overload
Electrolyte disturbances
Other treatment-specific complications
Not all patients are candidates for IV therapy.
Oaks Health does not guarantee that IV therapy will prevent, cure, or treat a particular medical condition.
Patients must complete required medical screening and informed consent documentation before receiving treatment.
8. MEDICAL AESTHETICS AND COSMETIC SERVICES
Oaks Health may provide cosmetic and aesthetic treatments, including injectable treatments, skin rejuvenation procedures, and other non-surgical aesthetic services.
Patients acknowledge that:
Cosmetic outcomes vary.
Results are not guaranteed.
Certain procedures may require multiple treatments.
Side effects and complications are possible.
Treatment recommendations are based on individual assessment.
Additional treatment may be necessary to achieve a desired result.
Separate procedure-specific informed consent forms may be required.
Before-and-after photographs, testimonials, and marketing materials are illustrative and do not guarantee individual results.
9. APPOINTMENTS, CANCELLATIONS, AND NO-SHOWS
Patients are responsible for scheduling and managing appointments through Oaks Health's designated scheduling systems.
Appointments are subject to availability and confirmation.
Patients should arrive on time and complete all required forms before their scheduled visit.
Cancellation, rescheduling, and no-show fees may apply when disclosed in the applicable appointment confirmation or financial policy and permitted by law.
Any applicable fees will be communicated before the patient becomes obligated to pay them.
Oaks Health reserves the right to reschedule appointments because of clinician availability, technical difficulties, emergencies, or other operational circumstances.
Patients will be notified of changes when reasonably possible.
10. PAYMENT AND BILLING POLICIES
10.1 Payment Responsibility
Patients are financially responsible for services received unless otherwise agreed in writing or required by applicable law.
Oaks Health may operate certain services on a self-pay basis.
Payment may be required before or at the time of service.
Fees may include:
Consultation fees
Follow-up appointment fees
Treatment and procedure fees
Laboratory testing fees
Prescription medication costs
Pharmacy fulfillment or shipping charges
Other disclosed service-related charges
Patients will be informed of applicable fees before payment is collected.
10.2 Insurance
Certain Oaks Health services are offered exclusively on a cash-pay or self-pay basis.
Oaks Health does not guarantee insurance reimbursement.
Patients are responsible for understanding their insurance coverage and any applicable restrictions.
Unless expressly agreed otherwise, Oaks Health does not submit insurance claims or obtain prior authorizations for services designated as self-pay.
Patients seeking insurance-covered medications or treatments may be advised to consult an insurance-participating healthcare professional.
10.3 Refunds
Refund eligibility depends on the service purchased, whether services have been rendered, and applicable law.
Consultation fees for completed clinical evaluations generally are not refundable solely because a patient is not approved for a requested treatment.
A consultation fee compensates the healthcare professional for the evaluation and clinical decision-making, regardless of the treatment outcome.
Prepaid services that have not been rendered will be reviewed under the applicable refund policy and governing law.
Refund requests must be submitted through an authorized Oaks Health communication channel.
10.4 Billing Disputes
Patients who believe a billing error has occurred are encouraged to contact Oaks Health before initiating a payment dispute.
Oaks Health will review billing concerns, investigate discrepancies, and provide an explanation or resolution when appropriate.
Patients retain all rights available under applicable consumer protection and payment laws.
Nothing in these Terms restricts a patient's legal right to dispute unauthorized or incorrect charges.
11. PATIENT PORTAL AND COMMUNICATIONS
11.1 Authorized Communication Channels
Oaks Health uses designated patient portals and official practice communication systems for clinical and administrative communications.
Patients are expected to use the secure patient portal for:
Medical questions
Prescription refill requests
Medication concerns
Appointment-related inquiries
Laboratory results
Treatment follow-up
Billing questions
Clinical documentation requests
Patients should not contact clinicians through personal telephone numbers, personal email addresses, or social media accounts for routine clinical matters.
Personal communication channels are not monitored as official clinical communication systems.
For privacy, safety, and documentation purposes, Oaks Health may redirect messages received through unauthorized channels to the secure patient portal.
11.2 Response Times
Patient portal messages are reviewed during normal business operations.
Oaks Health strives to respond to routine portal communications within three business days.
Response times may vary because of clinical volume, weekends, holidays, staffing, or other operational circumstances.
The patient portal is not intended for urgent or emergency medical concerns.
11.3 Electronic Communication Risks
Patients acknowledge that electronic communication may involve technical interruptions or security risks.
Oaks Health uses appropriate administrative, physical, and technical safeguards to protect patient information in accordance with applicable law.
Patients are responsible for maintaining the confidentiality of their portal login credentials and notifying Oaks Health of suspected unauthorized account access.
12. EMERGENCIES AND URGENT MEDICAL CONDITIONS
Oaks Health's website, patient portal, and routine telemedicine services are not emergency medical services.
Patients experiencing a medical emergency should call 911 or seek immediate evaluation at the nearest emergency department.
Examples of emergencies include:
Chest pain
Severe difficulty breathing
Stroke-like symptoms
Severe allergic reactions
Uncontrolled bleeding
Loss of consciousness
Severe or rapidly worsening symptoms
Thoughts of suicide or immediate risk of self-harm

13. PRIVACY AND CONFIDENTIALITY
Oaks Health is committed to protecting patient privacy and confidential medical information.
Protected health information is handled in accordance with applicable federal and state privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA), when applicable.
Medical information may be collected, used, and disclosed for treatment, payment, healthcare operations, and other purposes permitted or required by law.

How medical information is used and disclosed
Patient privacy rights
Medical record access

Records are retained in accordance with applicable federal and state laws.
Patients may request access to their medical records as permitted by law.
Requests for medical records should be submitted through an authorized practice communication channel.
Oaks Health may require identity verification before releasing protected medical information.
Patients retain all legally established rights regarding access, amendment, and disclosure of their medical records.

Medical outcomes vary among individuals.
Oaks Health does not guarantee:
Specific weight loss results

Medication effectiveness
Eligibility for a requested treatment
Availability of a specific prescription medication
Particular wellness outcomes
Clinical recommendations are based on available medical information, professional judgment, and applicable standards of care.
No statement on the website should be interpreted as a guarantee of medical results.
19. LIMITATION OF LIABILITY
To the extent permitted by applicable law, Oaks Health is not responsible for losses arising solely from circumstances beyond its reasonable control, including certain internet outages, telecommunications interruptions, and independent third-party service disruptions.
Nothing in these Terms excludes or limits liability for professional negligence, medical malpractice, violations of patient rights, privacy or security obligations, or other liability that cannot legally be excluded or limited.
Nothing in these Terms waives a patient's right to pursue remedies available under applicable law.
20. TERMINATION OR DISCONTINUATION OF SERVICES

Reasons may include:
Repeated failure to follow agreed-upon treatment requirements
Threatening or abusive conduct
Fraudulent or materially inaccurate information
Failure to satisfy lawful financial obligations
Inability to provide services legally in the patient's location
Clinical circumstances requiring a different level of care

When an established provider-patient relationship exists, Oaks Health will comply with applicable professional and legal requirements concerning termination of care, including appropriate notice, transition arrangements, and avoidance of patient abandonment.

For patients receiving telemedicine services outside North Carolina, applicable laws of the patient's physical location may govern professional licensure, standards of care, prescribing, patient rights, and other healthcare matters.
Nothing in these Terms is intended to override mandatory patient protections or other applicable legal requirements.
